Welcome to Stryve Daily ("the App"). These Terms of Service ("Terms") form a binding agreement between you and TITO Interactive ("we," "us," or "our"), the owner and operator of the App. By downloading, installing, accessing, or using Stryve Daily, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the App. By using Stryve Daily, you represent that you meet this requirement and that the information you provide is accurate.
2. License to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Stryve Daily for your own personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, reverse-engineer, or attempt to extract the source code of the App except as permitted by applicable law.
3. Free version & advertising
Stryve Daily is available to use free of charge. The free version of the App displays advertisements. Advertising helps us keep the App available at no cost to users who choose not to purchase the premium upgrade.
4. Premium upgrade (one-time in-app purchase)
Stryve Daily offers a one-time in-app purchase that upgrades your account to Premium. After purchasing Premium, you will no longer see advertisements within the App.
The following terms apply to the Premium upgrade:
- One-time payment. Premium is a single, one-time purchase. It is not a recurring subscription, and you will not be charged again for the ad-free upgrade.
- What you get. Premium removes advertisements from the App for as long as you use it on a supported account or device, subject to these Terms and the policies of the applicable app store.
- Billing. Payment is processed through the platform from which you downloaded the App (for example, the Apple App Store or Google Play Store) in accordance with that platform's terms. We do not directly collect or store your payment card details.
- Restoring a purchase. If you reinstall the App or switch devices, you may restore your Premium purchase through the relevant app store's "restore purchases" feature, where supported.
- Taxes. Prices may be subject to applicable taxes, which are determined and collected by the app store.
5. Refunds and cancellations
Because the Premium upgrade is purchased through a third-party app store, all refund requests are handled according to that store's refund policy. We do not directly process refunds. To request a refund, please contact the app store where you made the purchase (Apple or Google). If you have questions, you may also reach us at the contact address below.
6. Your content and data
Stryve Daily lets you create tasks, habits, lists, and related content. You retain ownership of the content you create. You are responsible for the content you store in the App and for maintaining your own backups where the App does not provide them. Our handling of your personal information is described in our Privacy Policy.
7. Acceptable use
You agree not to use the App to:
- Violate any applicable law or regulation;
- Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems;
- Circumvent, disable, or tamper with the advertising or in-app purchase features; or
- Use the App in any way that could harm us or other users.
8. Intellectual property
The App, including its design, branding, logos, text, graphics, and software, is owned by TITO Interactive and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding without our prior written permission.
9. Disclaimers
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, regarding the App, including its reliability, availability, or fitness for a particular purpose. Stryve Daily is a productivity and habit tool and is not intended to provide medical, psychological, financial, or professional advice.
10. Limitation of liability
To the fullest extent permitted by applicable law, TITO Interactive will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the App. Nothing in these Terms limits any rights you may have that cannot be excluded under applicable law.
11. Changes to the app or these terms
We may update, modify, or discontinue features of the App at any time. We may also revise these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
12. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Canada for the resolution of any disputes, except where applicable consumer protection law grants you the right to bring proceedings in your own jurisdiction.
